The Charity Commission tells me Islamic Help is co-operating with them and there is no need to open a statutory inquiry under section 8 of the Charities Act.
The Charity Commission explains: “Because there is no inquiry open, we do not have the power to direct the trustees. It is therefore true to say that we have not issued the charity with any "specific orders". However, in relation to the funds raised by the appeal, the trustees are legally in breach of trust and they are legally required to remedy this. We have given them regulatory advice to this effect. We will therefore work with the trustees to resolve the situation. If it becomes necessary and appropriate, we will consider what powers are open to us to ensure an appropriate resolution to the situation.”
